    Over the summer, my wife and I bought a new home. As part of the concessions, the previous owners were to have the pool open and ready before the closing date. The previous owner contacted Kirk’s Pool and Hearth to do that work. Even though our closing date was pushed back a week, they were unable to complete the agreed upon work by the agreed upon date. Kirk’s argued that money should have been set back in escrow for the work…even though the reason that it was not (as it was with other agreed upon work which was known would not be completed before closing) was their own incompetence to complete the work by the agreed upon date before the closing. Given that they were unable to complete the work in a timely manner, it required more chemicals to complete the job. The previous owner sent Kirk’s a check, but for a lesser amount than Kirk’s would have liked. He felt, for some reason, that his only recourse was to sue my wife and I for the inflated bill (which was inflated because of Kirk’s incompetence). The case was dismissed, because it was completely baseless. Just beware, if you do business with this person, this is the sort of thing that he thinks that this is an acceptable way to do business and treat people.

    If it was possible to give negative stars I would. He doesn't communicate well, and when he does it's usually a lie or half truth. As a matter of fact, his poor communication skills led to us having to spend almost $4,000 and a month's worth of sweat to build a retaining wall. Without the wall, the build strategy he employed would have caused flooding and erosion on and under my existing carport and would have left my neighbors' driveway a mess everytime it rained. But of course, a crook like Ken Kirk loves to hide behind word games like, "I can build your pool without a retaining wall". Sure you can; Ford can build me an F150 with no brakes too but it would be a terrible idea to buy or drive such a vehicle. New pool had hole in liner. He tried selling us a slide that wasn't the one under contract. He wasted 5 full work weeks of dry sunny days after we got done with the wall to go work on other pools. This led to him and his crew trying to cram most of the backfilling work and concrete into the last couple weeks on the contract, which probably has a lot to do with all the droppage we have seen from our concrete in such a short time. His concrete worker drank on job. They didn't compact the soil underneath my concrete decking properly or put down a layer of gravel before pouring, so now I have a sinking slab of concrete. In one corner, it has dropped 2 inches in the first 5 months since being poured. ***UPDATE*** After watching our concrete drop at an alarming rate in such a short time we decided it was becoming a trip hazard in at least one area so we opted for PolyLevel repair. Cantey Foundation Repair did the work and was able to raise the slabs up to alleviate the trip hazard and improved the worst corner by an inch and a half. Unfortunately, this "fix" cost us over $5,300, and that's on a pool deck that's barely 7 months old now. Don't hire Ken Kirk, he is a crook. Subcontractors didn't cost me almost $4,000 for a retaining wall by not communicating the build strategy, your boy Ken did that. Subcontractors didn't try selling us the wrong slide, your boy Ken did that. Subcontractors didn't decide to abandon our pool build for 5 weeks, your boy Ken did that. Subcontractors didn't rush and botch the backfill/tamp portion of our job, thus causing all our concrete issues that ended up costing us over $5,300 to fix; your boy Ken and his teen age know nothing employees did that.
